Hi,my dad has recently gone into a home and my sister has all of my dads cards for his bank,she is spending his pension and his private pension money on herself,she is not power of attorney and has not got courts protection.I am his executor to his will and his next of kin.Is my sister breaking the law? by spending his money without any permission from my father as he has dementia.

She sure is and you know it, so you are responsible to file a police report.

Yes she is breaking the law.. The NH will want payment and she's going to have to come up with the money..

As executor of his will you're only responsible for disturbing his assets AFTER he has passed..

You should call the police and Adult Protective Services (APS) and report your sister.

What she is doing is a form of abuse of the elderly. Call APS immediately, before she spends more. if she spends his money, there may be a shortage of money to pay his NH, then what? With a pension income source, he may not be eligible for Medicare, and when he did apply they would penalize him for the misspent monies. This can have very serious consequences for him.
